Overview of BOCW Act Registration
To resolve the issues of unskilled labourers who work in intensive pitiful conditions, government of India has introduced the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996; the Act is also called “BOCW Act”. The purpose of this Act is to keep an eye on the working conditions of the workers. It acts as a social welfare scheme that works with the motive to provide benefits to the workers who are involved in the activities related to building and construction across the country. The preamble of the BOCW Act explains the following:
“An act to regulate the employment and conditions of service of building and other construction workers and to provide for their safety, health and welfare measures and for other matters connected therewith or incidental thereto.”
The zone of BOCW Act is extensive, its aspects cover framework of other labour law legislations but specifically talking it coordinates a lot with the Factories Act, 1948.
Objective of UP BOCW
The people employed in Building and other Construction Works includes workers from unorganized sectors which are associated with very poor and the oppressed class. In order to facilitate improvement in their working and with the aim to provide financial aid under such conditions, the government led to the formulation of board for providing financial aid to them for their benefit under various schemes.
Purpose of forming BOCW
- The BOCW Act makes sure that workers are not being exploited and a healthy and safe working environment is provided to them.
- Government of India has made it mandatory for every State government to constitute their own Building and Other Construction Workers Welfare Boards.
- The functions BOCW include providing quick help to the workers in case of any mishap or accident, providing pensions, issuing loans for house construction, making payments related to premia for Group Insurance Scheme, providing financial aid for children’s education, supporting workers by carrying their medical expenses in case of major ailment.
- Each building laborer who is between the age of eighteen and sixty and who has been engaged with any building or other development work for at the very least ninety days during the previous a year is qualified for registration as a recipient of the BOCW Welfare Fund under this Act.
- Workers can apply for the registration in the prescribed form with the requisite documents and registration fee which is not more than fifty rupees.
- Application is filed to the officer authorized by the Board in this behalf.
Registration of building workers as beneficiaries
- Every building worker who has completed eighteen years of age, but has not completed sixty years of age, and who has been engaged in any building or other construction work for not less than ninety days during the preceding twelve months shall be eligible for registration as a beneficiary under this Act.
- An application for registration shall be made in such form, as may be prescribed, to the officer authorised by the Board in this behalf.
- Every application under sub-section (2) shall be accompanied by such documents together With such fee not exceeding fifty rupees as may be prescribed.
- If the officer authorised by the Board under sub-section (2) is satisfied that the applicant has complied with the provisions of this Act and the rules made thereunder, he shall register the name of the building worker as a beneficiary under this Act: Provided that an application for registration shall not be rejected without giving the applicant an opportunity of being heard.
- Any person aggrieved by the decision under sub-section (4) may, within thirty days from the date of such decision, prefer an appeal to the Secretary of the Board or any other officer specified by the Board in this behalf and the decision of tile Secretary or such other officer on such appeal shall be final: Provided that the Secretary or any other officer specified by the Board in this behalf may entertain the appeal after the expiry of the said period of thirty days if he is satisfied that the building worker was prevented by sufficient cause from filing the appeal in time.
- The Secretary of the Board shall cause to maintain such registers as may be prescribed.

Every Employer which hires 50 or more than 50 workers in any building or other construction work has to obtain BOCW Registration Certificate within 60 days from the commencement date.

Register in Online portal using their personal Details and Contact Details and login into the portal
After logging into the web portal, the applicant shall fill the common application form and add a unit and then shall need to click on apply for Permissions/ NOC's/ License option and select the unit and select Registration under The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996
Then click on fill form for Registration under The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 After completing all entries of the application, click on calculate fee and submit the form. And then click on pay consolidated fee and proceed for payment.

Any construction worker who is a registered member of the Board can get benefit of the welfare schemes for himself and for his family members.
BOCW Smart Card is a certified SCOSTA Card used as per the several eGovernance policies laid down by Government of India. The Smart Card is printed with all the basic details of the Labor and several other vital details are stored in the Chip embedded on the Card.
